Ulster County Files New Charges against Ulloa

STONE RIDGE � On Monday, October 18, Richard Ulloa of Stone Ridge got a call from State Police Investigator Mario Restivo who informed Ulloa that there was an arrest warrant for Ulloa from Ulster County dated October 14, 2010 and signed by Honorable Christopher Cahill, Supreme Court Judge.

The warrant charged, "Richard E. Ulloa with the crimes of 'Offering a False Instrument for filing in the First Degree (four counts).'" A Grand Jury indictment signed by Ulster County District Attorney Holley Carnright accompanied the warrant.

Richard Ulloa is a member of the "patriot" movement who, on June 18, 2010, was indicted on four counts of felony mail fraud stemming from more than $1.2 trillion worth of liens he filed against various county and town officials. In response to his actions, a federal civil RICO suit was filed against Ulloa and others by the parties against whom Ulloa's flurry of liens were filed.

After Investigator Restivo informed Ulloa about the warrant, Ulloa said he voluntarily surrendered and was to meet Restivo to be booked at the State Police Troop F Barracks on Route 209 in Kingston. Ulloa said when he arrived at the barracks at the agreed upon time, Restivo was not there having been called away to investigate an accident. The officer on duty knew nothing about what Restivo and Ulloa discussed on the phone, which according to Ulloa was that he would be booked and immediately arraigned. Instead Ulloa said he was booked and remanded directly to jail.

In June of 2010, Ulloa was arrested on four counts of Federal mail fraud. Factually they are the same set of liens that Ulloa was indicted for in June with his trial for these commencing on November 9. Ulster County Assistant District (ADA) Attorney John Tobin, who is prosecuting Ulloa on the new charges, said, "My case has nothing to do with the mail; I am dealing with false Universal Commercial Code (UCC) 1 Liens."

False UCC 1 Liens, according to Tobin, charges Ulloa with actually defrauding a state agency by filing false liens against it. He added that the state agency cited is the New York State Department of State.

On October 19 Ulloa was arraigned in Ulster County Supreme Court before presiding Justice Donald Williams. Ulloa said that Justice Williams asked ADA Tobin, "Is this not double jeopardy?"

In a subsequent phone interview with ADA Tobin after Ulloa's arraignment, he confirmed that Judge Williams did ask that question.

Although at the time of the arrest, it was reported that it was a "sealed" indictment, ADA Tobin stated that it changed after Ulloa's arraignment.

"This is now an unsealed indictment on four counts on the Class E felony called Offering a False Instrument for Filing in the First Degree, a felony."

Ulloa was released on $10,000 bail on Thursday, October 21 and stated that bail should not have been set as he had voluntarily appeared.

According to ADA Tobin, there is no trial date on the new charges yet, "There are standard pre-trial proceedings before setting a date for trial," he said.
